A Dairy Mart "affiliate" franchise permits a franchise owner to operate a convenience store under the "Dairy Mart" brand name owned by Mac's Convenience Stores LLC ("Mac's") or its affiliates, and to participate in certain vendor buying programs. Additionally, a franchise owner may offer gasoline for sale and provide related goods and services. Mac's will determine whether or not the franchisee will offer gasoline for sale but the franchise owner can choose whether to sell branded gasoline or unbranded gasoline, subject to the availability of the brand in the area in which Franchisee will be located and subject to other restrictions of the supplier.
